In some situations, your license can be taken away before you even go to court.  A new Wisconsin law enacted in 2010 makes drinking and driving penalties even more serious.  For example, if you are charged with drinking and driving with a child under the age of 16 in the vehicle, you will be charged with a crime.  Additionally, if you have a blood alcohol level of 0.15, you will be ordered to install an interlock ignition device in all of your vehicles for at least one year.

Penalties for operating a motor vehicle while intoxicated range from a forfeiture and license revocation for a first offense, to up to 6 years imprisonment, 3 year license revocation and possible seizure of vehicles for subsequent offenses. Additionally, more severe penalties apply if injury or death results. Under Wisconsin’s new drinking and driving laws, you are also at risk the court ordering an interlock ignition device installation on all vehicles you own.

It is illegal in Wisconsin for a driver over the age of 21 to operate a motor vehicle while intoxicated, while having a blood alcohol concentration of  0.08 or more, or while under the influence of any drug.

For drivers with three or more prior Operating While Intoxicated (OWI) convictions, the limit is lower: they cannot operate a motor vehicle if their BAC is greater than 0.02

Drivers under 21 years of age are required by law to maintain "absolute sobriety," and, for them, driving with any amount of alcohol in their system is illegal.
